In consideration of the services of The Break Room, their agents, owners, officers, managers, Volunteers, participants, employees, Staff and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "TBR), I hereby agree to release, indemnify, and discharge, TBR, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:
1. Acknowledge that my participation in TBR activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: Slipping and falling; confined spaces; flying debris; collision with fixed objects; strains; sprains; broken bones and musculoskeletal injuries including head, neck, eyes, and back injuries; emotional injury, cuts; abrasions; bruises; cardiac related illness; organ damage; hearing loss, or even more severe life threatening hazards; the negligence of participants; equipment failure; my own physical condition, and the physical exertion associated with this activity. Furthermore, TBR staff have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction. Those pregnant, have heart trouble should not participate. Anyone under the influence of drugs or alcohol are not permitted.
2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.
3. 1 hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless TBR from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of TBR equipment or facilities, including any such claims which allege negligent acts or omissions of TBR.
4. If I bring in a birthday card that I either purchased or printed and I have written on the card the exact sentence "The Break Room has the best stuff to break" I will receive 1 case of bottles free to break during my Rage Room purchase or a free hole punch on my rewards card for any other experience after purchase. Limit 1 per paying customer.
5.Should TBR or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
6. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical conditions I may have.
7. In the event that I file a lawsuit against TBR, I agree to do so solely in the State of Texas. and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and affect.
We RESERVE THE RIGHT to stop any session without a refund which becomes abusive to others whether physically or verbally!
By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against TBR on the basis of any claims from which I have released them herein. I have had sufficient opportunity to read this entire document, I have read and understood it, and I agree to be bound by its terms.
MINOR RELEASE
AND I, THE MINOR'S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF TBR ACTIVITIES AND THE MINOR'S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE'S FROM ALL LIABILITY CLAIMS, DEMANDS, LOSSES OR DAMAGES ON THE MINOR'S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE. INCLUDING NEGLIGENT RESCUE OPERATION AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR'S BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNITY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH Claim.
